If you were injured at work and your employer carries workers’ compensation insurance you should speak with an attorney right away about your rights to compensation.

What's in it For You?

Worker’s compensation is designed to make you whole.  While you may never recover completely from your injuries, the system is designed to provide you with covered medical care to get you as close to your pre-injury state as possible.  Financially, it is intended to compensate you while you are off work, and to pay you benefits if you have suffered permanent impairment as a result of the injury.  These benefits are calculated based upon the injured workers’ pre-injury wages.  A qualified and experienced attorney here at Espinoza & Brock can help you get what you’re entitled to.  Potential benefits can include:

  • Temporary Income Benefits (TIBS)
  • Impairment Income Benefits (IIBs)
  • Supplemental Income Benefits (SIBs)
  • Lifetime Income Benefits (LIBs)
  • Death Benefits (DBs)

You don’t have to face this situation alone. You have someone to help you who has experience dealing with workers’ compensation.  Amanda J. Spencer, Worker’s Compensation Partner at Espinoza & Brock, is certified as a workers’ compensation expert by the Texas Board of Legal Specialization. She is one of only a handful of Claimant’s attorneys in the State of Texas who is Board Certified, and is the only Board Certified workers’ compensation claimant’s attorney in the Greater San Antonio Area or El Paso. She and her team of trained professionals and staff work hard to advocate for injured workers in and out of the courtroom.

Know Your Responsibilities When Filing a Claim:

  1. You have 30 days to notify your employer that you were injured while performing the duties of your job.  The sooner you report your injury or work-related illness, the better.
  2. You have the right to choose your doctor and seek medical attention but you must tell your doctor that the injury happened while working. You have the right to choose your treating doctor, but you must select someone who takes workers’ compensation and, if your claim is in-network, your doctor must be in that network.  We can help you find the right doctor for your injuries.
  3. You must submit a completed “Employee’s Claim for Compensation for a Work-Related Injury or Occupational Claim” form to the Texas Division of Workers’ Compensation within one year of the date the “Employer’s First Report of Injury or Illness” is filed with the State or you could lose your right to obtaining benefits.  We can help!

Why Should I get a Workers’ Comp Attorney?

The compensation claims process is not something you should have to do alone.  You want to make sure that you recover everything you are entitled to. An experienced workers’ compensation attorney can help you understand your rights, get treatment, and get compensated for lost wages and permanent impairment.  Injured workers have an uphill battle to fight against insurance companies and attorneys for their benefits when.  Injured workers have the burden to prove that they were injured at work, how badly they were injured, and the disability benefits they should be entitled to.  This often requires expert opinions, hearings and other legal proceedings, evidence, state mandated forms and more that lay people are not familiar with.  Our mission at Espinoza & Brock is to give our clients a strong voice where they may have none, we demand respect for our clients when they have been disrespected, and we restore hope to those who feel hopeless against their corporate Goliaths.
